The lawyers for the man found guilty of killing former New Orleans Saints star Will Smith are asking for a new trial.
Attorneys representing Cardell Hayes filed the motion two days after a ruling by the U.S. Supreme Court that non-unanimous jury verdicts violate the Constitution.
In 2016, Hayes was convicted of manslaughter by a jury vote of 10-2 and sentenced to 25-years for shooting Smith and wounding his wife Raquel in a road-rage incident in New Orleans.
Orleans Parish District Attorney Leon Cannizzaro said he would contest the motion and that Hayes has already exhausted his appeals.
