New Orleans police are admitting that a former Louisiana congressman wasn't ticketed or tested for sobriety after a one-car crash in April.

Cedric Richmond ran into a tree near the intersection of North Claiborne Avenue and Lafitte Street, landing himself and his young son in the hospital.

The NOPD on Tuesday stated the responding officer determined he didn't have probable cause to give Richmond a field test for impairment.

Mayor LaToya Cantrell has defended the officer's decision.
