The Orleans Parish Sheriff's Office is asking for a federal lawsuit over the death of an inmate to be thrown out.

The department has filed a motion to dismiss the lawsuit from relatives of Chad Neyland, claiming the defendants were served improperly and the case shouldn't be in federal court.

The lawsuit claims the Sheriff's Office did not provide adequate care for Neyland, who died when he reportedly jumped from a balcony inside the jail last year.

If the case is not dismissed, the motion asks for several department officials to be removed as plaintiffs, including Sheriff Susan Hutson.
