A federal judge says Calvin Duncan will be allowed to take office as Orleans Parish Criminal District Court Clerk today after all.

The state Legislature passed a law last month that merged two clerk positions into one, eliminating Duncan's elected position. Chelsey Richard Napoleon was appointed to the combined position.

U.S. District Judge John deGravelles ruled the law unconstitutional on Sunday.
