Federal Court Revives State Law Eliminating Calvin Duncan's Office

Calvin Duncan's tenure as Orleans Parish Clerk of Criminal District Court is on hold again and may be over.

A new state law had consolidated the criminal and civil clerk functions into a single position held by Chelsey Richard Napoleon.

A federal judge in Baton Rouge ruled on Sunday that the state law is unconstitutional and temporarily blocked it from taking effect.

About two hours after Duncan assumed his elected office on Monday, the Fifth U.S. Circuit Court of Appeals issued a stay on the judge's order.

The legal battle continues.
